  Regular Meeting Minutes

August 7, 2024

CALL TO ORDER:

Chairman Mike Parker called the meeting to order at 6:57 p.m.

PLEDGE OF ALLEGIANCE:

Chairman Mike Parker led the Pledge of Allegiance.

ROLL CALL:

Trustees Parker, Miller, Leber, and Fiscal Officer Melissa Pelletier are present. Road Superintendent and Zoning Inspector Andy Dunlap is also present.

MINUTES:

The fiscal officer sent out minutes electronically before the meeting for approval.

Motion

Mr. Leber moved to approve the minutes, and Mr. Miller seconded the motion. A verbal vote was taken, and the motion passed unanimously.

GUESTS:

Prosecutor Charles Bennett joined Oxford Township to complete a resolution.

ZONING INSPECTOR:

One permit was issued for the addition of an accessory structure.  

A neighbor contacted the Health Department about an address on Patten Tract. The Health Department then contacted the zoning inspector about a nuisance. The complaint was high grass and a foul smell.

The homeowner has been locked out of the house due to a court order, which was unpleasant to the zoning inspector. Sherrif Sigsworth has been notified.

This address has been cited on two occasions.

Prosecutor Charles Bennett has suggested that resolutions can be passed for homeowners and resolutions for health, morals, and safety. These resolutions have been written and passed in Groton Township. After resolutions have been passed, citations may be issued. These resolutions protect homeowners’ constitutional rights first, then neighbors.

ROAD SUPERINTENDENT:

The Cemetery Grant was filled out and sent in electronically; thanks to Melissa and Lisa for their help.   

Oxford Township sold our old generator on GovDeals for $2,550 and was picked up by the highest bidder. GovDeals will deposit the money into the account listed through the initial setup process.

Paver Tires were loaded with Calcium Chloride; this process added 900 lbs per tire. 

We did not receive the EPA Chloride Reduction Grant that was applied for earlier in the year.

Chip Seal was supposed to start tentatively on Monday. As of 8.7.24, Andy has not seen them in the area. 

TRUSTEES

Trustee Parker:

Trustee Parker informs the Board that the Community Investment Grant was granted and accepted and is earmarked for siding along the back of the building. These improvements will complete the siding project and prevent water intrusion, improving its appearance.

Mr. Leber:

The insurance company did send the reimbursement for the generator and service call.

Mr. Leber is still having issues with the credit card and is working diligently to resolve it with Civista.

Mr. Miller-

Trustee Miller inquired about repairs on the Wood Rd. Bridge. The county maintains this particular bridge.

FISCAL OFFICER

50,000.00 dollars have been transferred from Star Ohio into our primary checking until we receive our refund from the commissioners

Passing of Two Resolutions

AMENDED RESOLUTION DECLARING NECESSITY TO LEVY A RENEWAL OF AN EXISTING TAX, AT THE SAME RATE OF TWO (2.0) MILLS IN EXCESS OF THE TEN (10) MILL LIMITATION for the purposeS of PROVIDING AND MAINTAINING FIRE APPARATUS, MECHANICAL RESUSCITATORS, UNDERWATER RESCUE AND RECOVERY EQUIPMENT, OR OTHER FIRE EQUIPMENT AND APPLIANCES, BUILDINGS AND SITES THEREFOR, SOURCES OF WATER SUPPLY AND MATERIALS THEREFOR, FOR THE ESTABLISHMENT AND MAINTENANCE OF LINES OF FIRE-ALARM COMMUNICATIONS, FOR THE PAYMENT OF FIREFIGHTING COMPANIES OR PERMANENT, PART-TIME, OR VOLUNTEER FIREFIGHTERS, EMERGENCY MEDICAL SERVICE, ADMINISTRATIVE, OR COMMUNICATIONS PERSONNEL TO OPERATE THE SAME, INCLUDING THE PAYMENT OF ANY EMPLOYER CONTRIBUTIONS REQUIRED FOR SUCH PERSONNEL UNDER SECTION 145.48 OR 742.34 OF THE OHIO REVISED CODE, FOR THE PURCHASE OF AMBULANCE EQUIPMENT, FOR THE PROVISION OF AMBULANCE, PARAMEDIC, OR OTHER EMERGENCY MEDICAL SERVICES OPERATED BY OXFORD FIRE DEPARTMENT, OR FOR THE PAYMENT OF OTHER RELATED COSTS AS PROVIDED IN OHIO REVISED CODE §5705.19(I), AND REQUESTING THE ERIE COUNTY AUDITOR CERTIFY TO THE BOARD OF TOWNSHIP TRUSTEES OF OXFORD TOWNSHIP ON A FORM IN ACCORDANCE WITH OHIO REVISED CODE § 5705.03, THE AMOUNT OF TAX GENERATED BY THE PROPOSED TAX LEVY IN THE AMOUNT OF TWO (2) MILLS, A TAX IN EXCESS OF THE TEN (10) MILL LIMITATION.

WHEREAS, the amount of taxes which may be raised within the Ten (10) Mill limitation will be insufficient to provide an adequate amount of revenue for the necessary requirements of the Oxford Township Fire Department; and,

WHEREAS, there is an existing tax levy of Two (2) Mills due to expire in tax year 2024, for the purpose of providing and maintaining fire apparatus, mechanical resuscitators, underwater rescue and recovery equipment, or other fire equipment and appliances, buildings or sites therefore, or sources of water supply and materials therefore, for the establishment and maintenance of lines of fire-alarm communications, for the payment of firefighting companies or permanent, part-time, or volunteer firefighting, emergency medical service, administrative, or communications personnel to operate the same, including the payment of any employer contributions required for such personnel under section 145.48 or 742.34 of the Ohio Revised Code, for the purchase of ambulance equipment, for the provision of ambulance, paramedic or other emergency medical services operated by a fire department or firefighting company, or for the payment of other related costs as provided in Ohio Revised Code §5705.19(I);

WHEREAS, it is necessary to renew the existing tax levy of Two (2) Mills due to expire in tax year 2024, for the purpose of providing and maintaining fire apparatus, mechanical resuscitators, underwater rescue and recovery equipment, or other fire equipment and appliances, buildings or sites therefore, or sources of water supply and materials therefore, for the establishment and maintenance of lines of fire-alarm communications, for the payment of firefighting companies or permanent, part-time, or volunteer firefighting, emergency medical service, administrative, or communications personnel to operate the same, including the payment of any employer contributions required for such personnel under section 145.48 or 742.34 of the Ohio Revised Code, for the purchase of ambulance equipment, for the provision of ambulance, paramedic or other emergency medical services operated by a fire department or firefighting company, or for the payment of other related costs as provided in Ohio Revised Code §5705.19(I)

WHEREAS, Ohio Revised Code §5705.03 requires that the taxing authority shall certify to the county auditor, a resolution or ordinance requesting that the county auditor certify to the taxing authority the total current tax valuation of the subdivision, and the number of mills required to generate a specified amount of revenue, or the dollar amount of revenue that would be generated by a specified number of mills.

NOW THEREFORE, BE IT RESOLVED that the Board of Township Trustees of Oxford Township, as taxing authority for Oxford Township, certify to Richard H. Jeffrey, Erie County Auditor, this resolution requesting that the Auditor certify to the Board of Township Trustees of Oxford Township, the total current tax valuation of the subdivision and the dollar amount of revenue that would be generated by a levy of renewal of an existing tax due to expire in tax year 2024, at the same rate of two (2) mills in excess of the Ten (10) Mill limitation, based on the following statements provided in compliance with the mandates of Ohio Revised Code §5705.03:

The renewal levy is for the purposes of providing and maintaining fire apparatus, mechanical resuscitators, underwater rescue and recovery equipment, or other fire equipment and appliances, buildings and sites therefor, or sources of water supply and materials therefor, for the establishment and maintenance of lines of fire-alarm communications, for the payment of firefighting companies or permanent, part-time, or volunteer firefighting, emergency medical service, administrative, or communications personnel to operate the same, including the payment of any employer contributions required for such personnel under section 145.48 or 742.34 of the Ohio Revised Code, for the purchase of ambulance equipment, for the provision of ambulance, paramedic, or other emergency medical services operated by a fire department or firefighting company, or for the payment of other related costs as provided in Ohio Revised Code §5705.19(I) ; and,

The proposed tax levy is a renewal of an existing tax, at the same rate of two (2) mills. The existing levy is due to expire in 2024; and

The section of the Ohio Revised Code authorizing submission of the question of the tax to all residents of Oxford Township, Erie County, Ohio, is Ohio Revised Code

§5705.19(I); and

The renewal levy is for a five (5) year period commencing in tax year 2024, and first due in calendar year 2025, being the tax duplicate years of 2024, 2025, 2026, 2027, and 2028, and

The renewal tax is to be levied on the entire territory of Oxford Township, Erie County, Ohio; and

The date of the election at which the question of the tax shall appear on the ballot is November 5, 2024; and

The ballot measure shall be submitted to the entire territory of Oxford Township, Erie County, Ohio; and

The tax year in which the tax will first be levied is 2024 and the calendar year in which the tax will first be collected is 2025; and

Erie County is the sole county upon which Oxford Township has territory.

BE IT FURTHER RESOLVED that the Fiscal Officer of the Board of Township Trustees of Oxford Township, Ohio, is hereby directed to immediately certify a copy of this Resolution to the Erie County Auditor.

BE IT FURTHER RESOLVED that this Board hereby finds and determines that all formal actions relative to the adoption of this resolution were taken in an open meeting of this Board; and that all deliberations of this Board and of its committees, if any, which resulted in formal action were taken in meetings open to the public in full compliance with applicable legal requirements including Ohio Revised Code §121.22.

AN AMENDED RESOLUTION DECLARING THE NECESSITY TO LEVY A RENEWAL OF AN EXISTING TAX, AT THE SAME RATE OF TWO AND ONE-HALF (2.50) MILLS IN EXCESS OF THE TEN (10) MILL LIMITATION FOR THE PURPOSE OF PROVIDING FUNDING FOR PAYMENT OF THE CURRENT EXPENSES OF OXFORD TOWNSHIP, AS PROVIDED FOR IN OHIO REVISED CODE 5705.19(A), AND REQUESTING THE ERIE COUNTY AUDITOR CERTIFY TO THE BOARD OF TRUSTEES OF OXFORD TOWNSHIP THE AMOUNT OF TAX GENERATED BY THE PROPOSED TAX LEVY IN THE AMOUNT OF TWO AND ONE-HALF (2.50) MILLS, A TAX IN EXCESS OF THE TEN (10) MILL LIMITATION.

WHEREAS, the amount of taxes which may be raised within the Ten (10) mill levy limit will be insufficient to provide an adequate amount of revenue for the necessary requirements of the current expense of Oxford Township; and

WHREAS, there is an existing tax levy of Two and One-Half (2.50) Mills due to expire in Tax Year 2024, for the purpose of providing funding for current expenses of Oxford Township, as provided by ORC 5705.19(A);

WHEREAS, there is a necessity to levy a renewal of the existing tax levy of Two and One Half (2.50) Mills due to expire in 2024, for the purpose of funding for payment of current expenses of the Township, as provided for in ORC 5705.19(A).

WHEREAS, ORC 5705.03 requires that the taxing authority shall certify to the county auditor a resolution requesting the auditor certify to the taxing authority the total current tax valuation of the subdivision, and the number of mills required to generate a specified amount of revenue, or the dollar amount of revenue that would be generated by a specified number of mills.

NOW THEREFORE BE IT RESOLVED that the Board of Township Trustees of Oxford Township, as Taxing authority for Oxford Township, certify to Richard Jeffrey, Erie County Auditor, this resolution requesting the Auditor certify to the Board of Trustees of Oxford Township, the total current tax valuation of the subdivision and the dollar amount of revenue that would be generated by a levy of renewal of an existing tax due to expire in tax year 2024, at the same rate of two and one-half (2.50) mills in excess of the Ten (10) Mill limitation, based on the following statements in compliance with ORC 5705.03:

The renewal levy is for the purpose of providing funding for payment of current expenses of the township, provided in ORC 5705.19(A)

Mr. Parker moved to approve the 2.0 mills resolution of necessity for the fire protection levy, and Mr. Miller seconded the motion. A verbal vote was taken, and the motion was passed unanimously and adopted.

Mr. Parker moved to approve the 2.5 mills resolution of necessity for the current expense levy, and Mr. Leber seconded the motion. A verbal vote was taken, and the motion was passed unanimously and adopted.

Mr. Leber motioned to pay all bills for Oxford Township with a second from Mr. Leber. The motion was carried out after a unanimous vote.
